Terms & Conditions
SCOPE & CONTRACT
These terms apply to all bookings of Tobias Deckert’s services. Clients are generally businesses, agencies or production companies; the services are not aimed at consumers. Conflicting terms of the client do not apply unless expressly agreed in writing. Enquiries via the contact form or email are non-binding; a contract is formed only when an individual written offer is confirmed in text form by either party.
SERVICES & FEES
The contractor provides the services described in the individual offer as a model or stunt performer to the best of his ability; no specific commercial success is owed. The daily fee covers a shooting day of up to 8 hours.
Overtime is charged per further hour started; more than two consecutive days may qualify for a multi-day discount. All amounts are net plus statutory VAT.
USAGE RIGHTS & BUYOUT
The fee covers the work on set only, not the use of the resulting images or footage. Usage rights (buyout) are charged separately and become effective only upon full payment of fee and buyout.
Scope, territory, type of use and duration are defined in the offer and calculated as a percentage surcharge on the daily fee (based on the VELMA buyout list). Use beyond the agreed scope, or transfer to third parties, requires a separate agreement. The contractor retains the right to his own image; use in a defamatory, political, discriminatory or pornographic context is excluded without separate consent.
STUNT, ACTION & TRAVEL
Stunt and action services are agreed and paid separately. Safety takes priority: approval and payment are based on a risk assessment of the probability and severity of injury. High-risk stunts are either not approved or performed only for a significantly increased fee and once all safety requirements are met. Complex stunts require a qualified stunt coordinator plus preparation and training time; the client provides adequate safety measures and insurance covering stunt work.
Standby days and travel days (for journeys over four hours) are charged at the agreed daily rate. Travel costs, accommodation, meals and production-related expenses are borne by the client. From roughly 400 km travel is by air; the departure point is preferably Salzburg, alternatively Munich.
PAYMENT & CANCELLATION
Unless agreed otherwise, invoices are payable within 14 days of the invoice date. For cancellation of a firmly booked date, a cancellation fee based on the agreed daily fee applies: free up to 14 days before; 50% from 13 to 7 days before; 75% from 6 days to 48 hours before; and 100% later than 48 hours before or for no-shows. Documented third-party costs such as cancelled travel are reimbursed additionally.
Events of force majeure, and weather unsuitable for outdoor shoots, entitle both parties to postpone the date. If the contractor is kept available on the booked day, a reasonable standby fee may apply as set out in the offer.
LIABILITY & FINAL PROVISIONS
The contractor is liable without limitation for injury to life, body or health and for damage caused by intent or gross negligence. For slight negligence he is liable only for breach of an essential contractual obligation, limited to foreseeable, contract-typical damage; otherwise liability is excluded. Responsibility for safety on set, compliance with occupational-safety rules and the required insurance lies with the client.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where the client is a merchant, the place of jurisdiction is the contractor’s registered office. Should any provision be or become invalid, the remaining provisions remain unaffected.
